5Space TERMS AND CONDITIONS OF VENUE USE
Membership
1. By accepting membership with 5Space (ABUNDANT STOREHOUSE LIMITED), you agree to be bound by these terms and conditions.
2. The office is offered on a monthly tenancy. Either you or 5Space (ABUNDANT STOREHOUSE LIMITED) may end this agreement by giving one month’s written notice.
2. Space Contribution
1. Space Contributions are payable monthly in accordance with an agreed usage (either fixed monthly or on an ‘as used’ basis) and will invoiced within the first week each month. Invoices are payable 7 days after invoice date.
2. Rent will be determined at the discretion of 5Space (ABUNDANT STOREHOUSE LIMITED) with 30 days notice given of any change in space contribution amounts.
3. Bookings are not able to be cancelled within 24hrs and will incur the full cost of space contribution.
3. Unpaid Fees
1. Any money owing to 5Space (ABUNDANT STOREHOUSE LIMITED) for more than 21 days shall bear interest of 10% per annum calculated daily until paid in full.
4. Services
1. Services are anything service provided to the Member that is not Rent for the Premises.
2. Wifi connection is available for unlimited access. 5Space (ABUNDANT STOREHOUSE LIMITED) reserves the right to stop connection in the case of excessive or illegal use.
3. Payment for use of additional services such as printing will be added to monthly invoice and charged with your monthly membership fees. Additional services will be charged in arrears on a monthly billing cycle.
5. Insurance
1. You agree that you are solely responsible for the security of your property in the workspace. It is your responsibility to arrange insurance for your own property which you bring to the workspace and for your own liability to your employees and to third parties. 5Space (ABUNDANT STOREHOUSE LIMITED) recommends that you put such insurance in place.
6. Termination
1. Either party may terminate by giving one month’s written notice
2. 5Space (ABUNDANT STOREHOUSE LIMITED) has the right to withhold Services and/or re-enter the Premises without prior notice and shall have a general lien on all property of the Member physically situated on any Premises of 5Space (ABUNDANT STOREHOUSE LIMITED):
A). Where the Member has failed to pay for rent or services in accordance with this rental agreement: or
B). Where the Member has breached any term of the Rental Agreement and fails to remedy that breach within seven days of being requested by 5Space (ABUNDANT STOREHOUSE LIMITED) to do so: or
3. The Member will be responsible for the 5Space (ABUNDANT STOREHOUSE LIMITED)’s reasonable costs in recovering any monies owed under this agreement.
7. Use and Care of Premises
As 5Space is a multi-user premises, it is important that members:
1. take care of the Premises and to keep office space and multi-use kitchen area in a clean condition;
2. leave each area clean and tidy ready for the next member, including switching off all lights & aircon and returning any moved furniture to its original place (for members using the Function room, please refer to the manual located next to the sound desk to ensure everything is switched off correctly)
3. not sleep overnight;
4. not smoke on our Premises;
5. not use the Premises for any immoral or illegal purposes;
6. Are aware that any damage caused to the fixtures, fittings and included equipment of the booked space by the booker and any attendees/colleagues will be charged.
8. Liability
To the maximum extent permitted under the law:
1. 5Space (ABUNDANT STOREHOUSE LIMITED), its related bodies corporate, their officers, employees, contractors and agents (“5Space (ABUNDANT STOREHOUSE LIMITED) Parties”) shall not be liable for any theft, loss or damage from the workspace howsoever occurring or for any damage done to the furniture or other effects of any other member in the workspace by the caretaker, cleaners or any employees, contractors, agents or invitees of 5Space (ABUNDANT STOREHOUSE LIMITED).
2. The 5Space (ABUNDANT STOREHOUSE LIMITED) Parties shall not be liable for any loss, damage or loss of information resulting from communications or data failure including voice, communication and the Internet.
3. The 5Space (ABUNDANT STOREHOUSE LIMITED) Parties shall not be liable for any loss, damage, corruption of data or any loss of information whether from hardware, software or Internet damage that may occur to a member during the term of this Agreement.
This clause “Liability” survives termination of any agreement.
